Another person claimed to be the spouse of the decedent and co-owned the out-of-state property as well as some other assets. After briefing the issue of common law marriage, the court agreed with us that there was no common law marriage, appointed our client as the personal representative (and sole beneficiary), and awarded our client attorney's fees.
